Terms and Conditions

Welcome to the MySole 3D foot scanning application (“the App”). These Terms and Conditions (“Terms”) govern your use of the App provided by MySole (“we,” “our,” or “us”). By using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

By accessing or using the App, you agree to comply with and be bound by these Terms and all applicable laws and regulations. If you do not agree to these Terms, please refrain from using the App.

2. Modifications to the Terms

We reserve the right to modify, update, or change these Terms at any time. We will notify you of any significant changes by updating the “Effective Date” at the top of this document. You are encouraged to review these Terms regularly. Your continued use of the App after changes to the Terms are posted constitutes your acceptance of those changes.

You must be at least 16 years old to use the App. If you are under the age of 16, you may not use the App without the consent of a parent or legal guardian. By using the App, you represent and warrant that you meet these eligibility requirements.

To use certain features of the App, you may be required to create an account. When you create an account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials, and you agree to notify us immediately of any unauthorized use of your account.

The primary service provided by the App is the collection and analysis of 3D foot scan data. You retain ownership of your 3D foot scan data but grant us a non-exclusive, worldwide, royalty-free license to use, store, and process your data for the purposes outlined in our Privacy Policy. We will not share your 3D foot scan data with third parties without your consent, except as described in the Privacy Policy.

7. Data Retention and Deletion

We retain your personal data, including 3D foot scan data, for as long as necessary to fulfill the purposes outlined in the Privacy Policy. If you wish to request the deletion of your data, you can contact us at compliance@mysole.ch. Please note that we may need to retain certain information for legal or business purposes.

We strive to ensure that the App is available and functional at all times. However, we do not guarantee uninterrupted access to the App. We may occasionally perform maintenance or updates that may temporarily affect access to the App. We are not responsible for any delays, interruptions, or errors caused by such maintenance or updates.

The App may integrate with third-party services, such as cloud storage providers, analytics services, or payment processors. By using the App, you agree to comply with the terms and conditions of these third-party providers. We are not responsible for the actions, policies, or content of third-party services.

10. Intellectual Property

The App, including its content, features, design, and functionality, is owned by MySole and is protected by copyright, trademark, and other intellectual property laws. You may not use, copy, modify, or distribute the App or any part of it without prior written consent from us.

11. Limitation of Liability

To the fullest extent permitted by law, MySole shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to any data loss, injury, or financial loss. This includes any damages arising from the use of third-party services or products integrated with the App.

12. Indemnification

You agree to indemnify and hold harmless MySole, its affiliates, employees, and agents from any claims, damages, liabilities, costs, or expenses (including attorney’s fees) arising from your use of the App or violation of these Terms.

13. Privacy and Data Protection

Your privacy is important to us. By using the App, you agree to the collection, use, and sharing of your personal data as described in our Privacy Policy. For more details on how we handle your personal information, please refer to the Privacy Policy, which is incorporated by reference into these Terms.

14. Termination

We reserve the right to suspend or terminate your access to the App at any time, without notice, for any violation of these Terms or for any reason, including but not limited to misuse of the App, breach of security, or non-payment of any fees.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Switzerland. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in Switzerland.

16. Dispute Resolution

In the event of any disputes related to the App or these Terms, we encourage you to contact us first to resolve the matter amicably. If a dispute cannot be resolved through negotiation, you agree to resolve the dispute through mediation or arbitration in accordance with Swiss laws.

17. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
